In a stunning example of moral sanity and common sense, the Department of Education will now reject any cases dealing with bathroom complaints by transgender students, reported BuzzFeed, and which leftist Rep. Nancy Pelosi (D-Calif.) addressed in a tweet with #ProtectTransStudents.

On Monday, leftist propaganda outlet BuzzFeed ran a story headlined, “The Education Department Says it Will Reject Transgender Bathroom Complaints.”

The story noted that the Trump administration, back in February 2017, rescinded Obama-era rules that said public schools should allow transgenders to use the bathroom of their choice, e.g., a male student who imagines he is female may use the ladies room. Since then, liberals and LGBT activists have demanded that the Trump administration clarify its position on this issue.

On Feb. 8, Education Department spokesman Liz Hill told BuzzFeed that the federal Title IX law “prohibits discrimination on the basis of sex, not gender identity.”

Sex refers to one’s biological makeup at birth: Male or female genitalia and, at the genetic level, two X chromosomes for female or an X and a Y chromosome for male. (Sometimes there are chromosonal abnormalities and there are hermaphrodites, but these cases are very rare.)

Hill further explained that Title IX does prevent harassment of any student based on sex, including transgenders, but it does not legally address the issue of bathroom complaints.

“Where students, including transgender students, are penalized or harassed for failing to conform to sex-based stereotypes, that is sex discrimination prohibited by Title IX,” she said. “In the case of bathrooms, however, long-standing regulations provide that separating facilities on the basis of sex is not a form of discrimination prohibited by Title IX.”

Catherine Lhamon, who worked in the Education Deprtment under President Obama, told BuzzFeed, “This new categorical bar of civil rights protection for transgender children required to atend schools every day ignores the text of the law, courts’ interpretation of the law, the stated position of the Department to date, and human decency.”

In reaction to the new reported policy, House Minority Leader Nancy Pelosi (D-Calif.), tweeted, “@BetsyDeVosED, you took an oath to protect children, students, teachers and school leaders of all backgrounds. Do your job. #ProtectTransStudents.”

According to the former psychiatrist-in-chief for Johns Hopkins Hospital, Dr. Paul R. McHugh, transgenderism is a “mental disorder” that can be treated and sex change is “biologically impossible” because one cannot change one’s chromosomes.

“This intensely felt sense of being transgendered constitutes a mental disorder in two respects,” said Dr. McHugh. “The first is that the idea of sex misalignment is simply mistaken – it does not correspond with physical reality. The second is that it can lead to grim psychological outcomes.”

The transgendered person’s disorder, said Dr. McHugh, is in the person’s “assumption” that they are different than the physical reality of their body, their maleness or femaleness, as assigned by nature. It is a disorder similar to a “dangerously thin” person suffering anorexia who looks in the mirror and thinks they are “overweight,” said McHugh.

He further said, “’Sex change’ is biologically impossible. People who undergo sex-reassignment surgery do not change from men to women or vice versa. Rather, they become feminized men or masculinized women. Claiming that this is civil-rights matter and encouraging surgical intervention is in reality to collaborate with and promote a mental disorder.”

Clearly, the proper response to transgenderism is mental health treatment, not bathroom reassignment.
